Agreement
These terms form a binding agreement between you and the operator of this Family Tracker service. By creating an account or using the applications, you accept them. If you do not accept them, do not use the service.
Eligibility and accounts
You must be at least 18 years old, or the age of majority where you live, to create a parent account. You are responsible for the accuracy of your account details, for keeping your password confidential, and for everything that happens under your account.
Notify us promptly if you believe your account has been accessed without your permission.
Lawful supervision — your responsibility
This service may only be used to supervise a member of your own family whom you have the legal right to supervise, typically a minor child for whom you are the parent or legal guardian.
You must not use the service to track, monitor or record any person without the legal authority to do so. Monitoring another adult without their knowledge and consent is unlawful in many jurisdictions and is a breach of these terms.
- You confirm you have the legal right to supervise every person you add to your family.
- You will comply with the laws of your jurisdiction on monitoring, recording and data protection.
- You will inform the supervised person as required by law and by the transparency measures built into the service.
- You accept sole responsibility for how you use the information the service provides.
We may suspend or terminate any account we reasonably believe is being used unlawfully.
Acceptable use
You must not misuse the service. In particular, you must not attempt to gain unauthorised access to any account or system, interfere with or disrupt the service, reverse engineer it except as permitted by law, resell it without our written agreement, or use it for any unlawful purpose.
Subscriptions and billing
Paid plans are billed in advance on the interval shown at checkout and renew automatically until cancelled. Prices are shown before you confirm a purchase.
Purchases made inside the iOS application are processed by Apple and purchases made inside the Android application are processed by Google, in each case under that store's terms. Purchases made on the website are processed by our payment provider.
You can cancel at any time. Cancellation takes effect at the end of the current billing period, and you keep access until then. Where a purchase was made through Apple or Google, refunds and cancellations are governed by that store's policy and must be requested through it.
A free trial, where offered, converts to a paid subscription at the end of the trial unless cancelled before it ends.
Service availability
We work to keep the service available and accurate, but we do not guarantee uninterrupted operation. Location accuracy depends on the supervised device, its operating system, its battery and power-saving settings, and network and satellite conditions that are outside our control.
Supervision features can be limited or disabled by the device operating system, by the device holder revoking a permission, or by the device being switched off.
Not an emergency service
Family Tracker is not an emergency service and must not be relied on as one. The SOS feature notifies the contacts in your family; it does not contact emergency services. In an emergency, call your local emergency number.
Intellectual property
The service, its software, design and content are owned by the operator and its licensors and are protected by intellectual property law. You receive a limited, non-exclusive, non-transferable right to use the service while your account is in good standing. Content you upload remains yours; you grant us the licence needed to store and display it for you.
Disclaimers and liability
To the fullest extent permitted by law, the service is provided "as is" and "as available" without warranties of any kind. We are not liable for indirect, incidental, special or consequential loss, or for loss of profit, data or goodwill.
Nothing in these terms excludes liability that cannot lawfully be excluded, including liability for death or personal injury caused by negligence or for fraud. Where liability can be limited, our total liability is limited to the amount you paid for the service in the twelve months before the event giving rise to the claim.
Termination
You may stop using the service and delete your account at any time. We may suspend or terminate access if you breach these terms, if required by law, or if continuing would create a security or legal risk. On termination, your right to use the service ends and your data is handled as described in the privacy policy.
Changes, governing law and contact
We may update these terms as the service develops. We will post the revised version here and, where the change is material, notify you in the application. Continuing to use the service after a change means you accept it.
These terms are governed by the law of the operator's place of establishment, without regard to conflict-of-law rules, and without depriving a consumer of the protection of the mandatory law of their own country of residence.
